91Ö±²¥â€™s Policy on Addressing Sexual Misconduct and Title IX Complaints with All Involved Parties
91Ö±²¥ is committed to adhering to its Student Sexual Misconduct and Interpersonal Violence Policy and Title IX for all persons involved with an act of sexual misconduct or relationship violence. This policy aims to ensure a fair, impartial, and equitable response in ascertaining responsibility of potential violations. As fully detailed in the policy itself and depending on the specific circumstances of each situation, the Student Sexual Misconduct and Interpersonal Violence provides for:
Access to campus resources for medical, counseling, and advisory services
Notification of and assistance in options for changing academic, work, or living situations at any time before, during, after, or in lieu of an investigation
A university-designated advocate and/or an advisor of choice to assist at any and all points in the support, investigative, and administrative processes.
An advocate can participate actively during all parts of this process, and is well-versed in the university policy.
The advisor of choice, who may or may not be affiliated with the university, to offer passive support throughout this process. This individual is unable to participate actively at any time, and is not confidential.
The preservation of privacy, to the extent possible and permitted by law
Encouragement to report sexual misconduct to both on-campus and off-campus authorities
A prompt and impartial investigation and appropriate resolution/sanctions for all credible complaints of sexual misconduct made in good faith to non-confidential resources
The ability to submit evidence and names of witnesses to be considered in the investigation process
Regular updates on the status of an investigation or resolution including:
Notice of investigation
Notice of policies violated
Notice of hearing
Notice of hearing outcome and sanctions, pending all appeals
Access to copies of relevant materials
Accommodations or interim measures throughout or in lieu of an investigation process to maintain safety between parties if so requested and deemed to be appropriate
The ability to review relevant evidence regarding the potential policy violation
A formal administrative hearing using the preponderance of evidence standard of proof, held by the university
The ability to make an impact statement that is considered in determining sanctions
Notification, in writing, promptly and privately of the outcome of an administrative hearing, pending all appeals
The ability to appeal the outcome of an administrative hearing
